Amara Events by Saulo González (hereinafter “Amara Events”, “we”, “us” or “our”), with address at Avenida Las Palmas 818, Plaza Riviera Ameca, Las Juntas, C.P. 48291, Puerto Vallarta, Jalisco, Mexico, is responsible for the processing, use and protection of your personal data.

This Privacy Notice covers the personal data collected through the website https://amaraevents.mx and through the communication channels associated with it.

This Privacy Notice is issued in accordance with Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares), its Regulations and other applicable provisions.

2. Personal data we collect

We collect the following personal data directly from you when you complete the request for proposal form on our website:

• Full name
• Email address
• Phone number
• Type of event
• Date of event
• Estimated guest count
• Target budget range
• Desired venue
• The details you share about your celebration
• How you heard about us

If you subscribe to our newsletter, we collect your email address. If you contact us by email, telephone or messaging applications, we collect the contact details and the content of your message. If you engage our services, we additionally collect the billing, tax and contractual information necessary to invoice you and to deliver your event.

When you browse our website, we also collect the following data automatically:

• IP address
• Browser type and version
• Operating system and device type
• Language settings
• Pages viewed and time spent on each page
• Referring website
• Date and time of access

We do not collect sensitive personal data through this website, meaning data relating to racial or ethnic origin, health, genetic information, religious, philosophical or moral beliefs, union membership, political opinions or sexual preference. We ask that you do not include information of this nature in the free-text fields of our forms. If, in the course of planning your event, it becomes necessary for us to know information such as dietary restrictions or accessibility requirements, we will request it separately and process it only for that purpose, with your express consent and with the reinforced level of protection the law requires.

Our website and services are directed to persons of legal age. We do not knowingly collect personal data from minors. If you believe a minor has provided us with personal data, please write to [email protected] so that we can delete it.

3. Purposes of processing

Your personal data is processed for the following primary purposes, which are necessary in order to attend to the request you have made:

• Responding to your inquiry or request for proposal
• Preparing, sending and following up on quotes, proposals and contracts
• Planning, coordinating and producing your event
• Coordinating with venues, hotels and suppliers on your behalf
• Processing payments and issuing invoices
• Providing customer service and post-event follow-up
• Complying with our legal, tax and accounting obligations
• Maintaining the security and correct operation of our website

Additionally, and only if you consent to it, we process your data for the following secondary purposes, which are not necessary for the service you have requested:

• Sending our newsletter, inspiration content and event planning ideas
• Sending promotional communications about our services
• Inviting you to take part in satisfaction surveys or to share a testimonial
• Preparing statistics and analytics to improve our website and our services

Before submitting any of our forms you are asked to confirm the box labelled “I agree to the Privacy Policy”, by which you acknowledge that this notice has been made available to you. Your consent to the secondary purposes listed above is not required in order for us to attend to your request, and you may object to them at any time without any effect whatsoever on the attention you receive or on the services we provide to you: simply use the unsubscribe link included in every message we send, or write to [email protected] with the subject line “Secondary purposes — opt out”.

4. Transfers of personal data

In order to plan and deliver the event you have contracted, we may transfer your personal data to the following third parties:

• Venues, hotels and resorts — to check availability, hold dates and coordinate the logistics of your event
• Suppliers and creative partners (catering, photography, video, floral design, music, audiovisual production, transport and similar) — to quote and deliver the services that form part of your event
• Accountants, auditors and legal advisors — to comply with our tax, accounting and legal obligations
• Competent authorities — where required by law or by a valid legal request

By providing your personal data through this website, you consent to the transfers described above. If you do not wish your data to be transferred to third parties for purposes other than those necessary to deliver your event, please let us know at [email protected].

Separately, we use the following service providers, who process personal data on our behalf, following our instructions and under contract. In accordance with the applicable regulations, engaging these providers does not constitute a transfer of personal data:

• Google LLC — business email (Google Workspace) and website traffic analytics (Google Analytics, integrated through Site Kit)
• MailerSend (MailerLite, UAB) — delivery of transactional email, including the notification of your form submission and the confirmations we send you
• MailerLite (MailerLite, UAB) — management and delivery of our newsletter and promotional communications
• Cloudflare, Inc. — content delivery network, DNS management and website security
• Cloudways / DigitalOcean, LLC — hosting of our website and of the database in which form submissions are stored

Some of these providers store and process information on servers located outside Mexico, particularly in the United States and the European Union. In every case we require them to maintain security measures and confidentiality obligations at least equivalent to those set out in this Privacy Notice.

We do not sell, rent or trade your personal data, and we do not share it with third parties so that they may use it for their own independent marketing purposes.

5. ARCO rights

You have the right to Access your personal data and to know the details of how we process it; to request its Rectification where it is inaccurate or incomplete; to request its Cancellation where you consider it is not being processed in accordance with the applicable principles and obligations; and to Object to its processing for specific purposes. These are known collectively as ARCO rights.

To exercise any of them, send your request to [email protected] including the following:

• Your full name and an email address or other means through which we can communicate our response to you
• A copy of an official identification document proving your identity or, where applicable, that of your legal representative together with the document proving such representation
• A clear and precise description of the personal data concerned and of the right you wish to exercise
• Any element or document that helps us locate your personal data

We will communicate our decision within a maximum of 20 business days from the date we receive your request. Where the request is granted, it will be implemented within the following 15 business days. These periods may be extended once, for an equal duration, where the circumstances of the case justify it. Submitting a request is free of charge; we may only pass on justified shipping costs or the cost of reproducing documents.

6. Revocation of consent and limitation of use or disclosure

You may revoke, at any time, the consent you have given us for the processing of your personal data, by sending a request to [email protected] following the same procedure described in the previous section. Revocation does not have retroactive effect, and in certain cases we may be unable to give full effect to it — for example, where we are required to retain records to comply with tax or legal obligations, or where the data remains necessary to complete an event you have already contracted.

You may also request that we limit the use or disclosure of your personal data. If you do not wish to receive promotional communications from us, in addition to writing to us directly, you may register your details in the Public Registry to Avoid Advertising (Registro Público para Evitar Publicidad, REPEP) maintained by Mexico’s federal consumer protection agency, available at https://repep.profeco.gob.mx.

7. Cookies and similar technologies

Our website uses cookies and similar technologies, which are small files stored on your device that allow the site to function correctly and help us understand how it is used. Specifically we use:

• Google Analytics, integrated through Google Site Kit — collects anonymised statistics on visits, pages viewed and browsing behaviour, so that we can improve the site. You may opt out of this collection by installing the official Google add-on available at https://tools.google.com/dlpage/gaoptout
• Cloudflare — sets strictly necessary cookies that allow it to distinguish legitimate visitors from automated traffic and to protect the site against attacks
• WordPress functional cookies — remember technical preferences needed for the site to display correctly

You may disable or delete cookies at any time from the settings of your browser (in Chrome, Safari, Firefox and Edge this is found under the privacy or security section). Please note that disabling strictly necessary cookies may prevent parts of the website from working correctly.

8. Data retention and security

We retain your personal data only for as long as necessary to fulfil the purposes described in this Privacy Notice and to comply with the legal, tax and accounting obligations that apply to us; enquiries that do not result in a contracted event are deleted after a reasonable period from your last contact with us. To protect your personal data against loss, misuse, unauthorised access, disclosure, alteration or destruction, we maintain administrative, technical and physical security measures, including encrypted connections (HTTPS/TLS), a web application firewall, access to our systems restricted on a need-to-know basis, and regular backups.

9. Changes to this Privacy Notice

This Privacy Notice may be modified or updated at any time in order to reflect changes in our services, in our practices, in the providers we work with, or in applicable legislation. Any change will be published on this same page, at https://amaraevents.mx/privacy-policy, together with the corresponding update date. We recommend that you review it periodically.

10. Competent authority

If you consider that your right to the protection of personal data has been infringed by any conduct on our part, or if you believe that in processing your personal data we have breached the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties, you may file a complaint with the Secretaría Anticorrupción y Buen Gobierno, the authority competent in these matters.
